Lula AI Terms of Use

Lula AI is a creative tool for parents and adult guardians. It uses artificial intelligence to generate personalized children's stories, artwork, narration, and optional synthetic voices. An adult must operate the service, have permission to provide all child information, photos, and voice recordings, and review generated content before sharing it with a child. Subscriptions renew automatically unless cancelled in Apple account settings.

These Terms of Use ("Terms") form a legal agreement between you and Horus Teknoloji ve Dijital Hizmetler, operating as Horus Studios ("Horus," "we," "us," or "our"), concerning your use of Lula AI (the "Service").

1. Agreement to these Terms

By downloading, accessing, purchasing, or using Lula AI, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you obtain Lula AI through Apple's App Store, your use is also subject to Apple's applicable terms, including the Apple Licensed Application End User License Agreement, except to the extent these Terms provide valid additional terms.

2. Eligibility and adult responsibility

You must be at least 18 years old or the age of legal majority where you live to create or manage a Lula AI account. Lula AI is designed to be set up and operated by a parent, legal guardian, or other authorized adult; it is not an account service for children.

If you provide information about a child, you represent that you are the child's parent or legal guardian, or that you have all legal authority and consent required to provide the information and use it through the Service. You are responsible for deciding whether Lula AI and each generated story are suitable for the child.

3. What Lula AI provides

Lula AI may allow you to:

• Create child profiles and choose story preferences.
• Generate personalized stories and illustrations using artificial intelligence.
• Generate narration and, where available, use an uploaded recording to create a personalized synthetic voice.
• Save, play, and share generated stories and media.
• Access free or paid usage allowances and subscription features.

Features, providers, limits, and availability may change over time. Some features require an internet connection, device permission, active subscription, or supported region and language.

4. Not professional or developmental advice

Lula AI provides creative entertainment and general educational content. It does not provide medical, psychological, therapeutic, developmental, educational, legal, or other professional advice, assessment, diagnosis, or treatment.

Information about a child's developmental considerations is used only to help personalize requested content. Do not rely on Lula AI to make health, safety, education, or care decisions. Consult a qualified professional when appropriate.

5. Accounts and device access

You are responsible for activity performed through your account or authorized device installation and for maintaining the security of your device and credentials. You must provide accurate information and promptly update information that becomes inaccurate. Notify us at hello@horusstudios.com if you believe your account or device access has been compromised.

You may not sell, transfer, rent, or provide unauthorized access to your account, subscription, or usage allowance.

6. Your content and permissions

"User Content" means information and material you provide to the Service, including child profile details, prompts, preferences, photos, voice recordings, feedback, and other uploads. You retain any rights you have in your User Content.

You grant Horus a worldwide, non-exclusive, royalty-free license to host, copy, transmit, format, modify, and otherwise process User Content only as reasonably necessary to operate, secure, support, and improve the Service; fulfill your requests; and comply with law. This license allows us to send relevant User Content to the service providers described in our Privacy Policy. It ends when the content is deleted from our systems, except for retained backups, de-identified information, legally required records, and information already processed as permitted by these Terms and our Privacy Policy.

You represent that:

• You own User Content or have all permissions and legal authority necessary to provide and use it.
• Providing and processing User Content does not violate privacy, publicity, intellectual-property, confidentiality, biometric, child-protection, or other rights.
• User Content is not unlawful, harmful, deceptive, abusive, or designed to facilitate wrongdoing.

7. Photos, recordings, and synthetic voices

You may upload a photo or voice recording only when you have authority to do so. For a voice recording, you must be the speaker or have the speaker's informed permission and legal authority to create and use a synthetic version of that voice. If the speaker is a child, the uploading adult must be authorized to consent on the child's behalf.

You must not use Lula AI to impersonate a person without authorization, deceive others about who is speaking, commit fraud, create political or commercial endorsements, bypass authentication, harass anyone, or create sexual, exploitative, or otherwise harmful content.

Removing a voice in the app may deactivate it before all stored or provider-side copies are erased. See the Privacy Policy or contact us to request deletion.

8. Artificial-intelligence output

Lula AI uses probabilistic artificial-intelligence systems. Generated stories, images, narration, and other output may be inaccurate, incomplete, unexpected, offensive, unsuitable, or similar to content generated for another user. Safety controls reduce risk but cannot eliminate it.

You are responsible for reviewing output before playing it to a child, publishing it, relying on it, or sharing it with anyone. Do not treat output as factual or professional advice. You must not use output to make decisions that could materially affect a person's rights, health, education, safety, finances, or legal interests.

We do not guarantee that output is unique, error-free, non-infringing, or eligible for copyright or other protection. To the extent permitted by applicable law and third-party provider terms, you may use generated output for personal, non-commercial purposes. Any broader commercial use requires our prior written permission and remains subject to applicable law and third-party rights.

9. Horus intellectual property

The Service—including its software, design, branding, interfaces, databases, templates, and other materials supplied by Horus—is owned by Horus or its licensors and is protected by intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use Lula AI on Apple-branded products you own or control, as permitted by Apple's Usage Rules, for personal and non-commercial use. No other right or license is granted.

If you send feedback or suggestions, you allow us to use them without restriction or compensation, provided we do not identify you publicly without permission.

10. Subscriptions, renewals, and billing

Lula AI may offer auto-renewing subscriptions and other in-app purchases. The paywall shown before purchase states the applicable product, duration, price, trial or introductory terms, and included benefits. Apple processes payment through your Apple Account.

• A subscription automatically renews for the displayed period unless you cancel it at least 24 hours before the end of the current period or Apple specifies a different deadline.
• Apple may charge your account within 24 hours before renewal at the price shown when you subscribed, subject to any price-change notice required by Apple or law.
• You can manage or cancel a subscription in your Apple Account subscription settings.
• If a free trial is offered, unused trial time may end when a paid subscription is purchased, as disclosed at purchase.
• You may use "Restore Purchases" where available to restore an eligible purchase.
• Deleting the app or your Lula AI account does not cancel an Apple subscription.

Refunds are handled by Apple under Apple's policies, except where applicable consumer law requires otherwise. We may change future prices or plan benefits with notice required by Apple or applicable law. Changes do not retroactively alter a completed billing period.

11. Acceptable use

You must not, and must not help anyone else to:

• Use the Service or output unlawfully or in violation of another person's rights.
• Exploit, endanger, sexualize, groom, identify, or target a child or other vulnerable person.
• Upload content you are not authorized to use, including a person's photo or voice.
• Create deceptive impersonations, fraud, threats, harassment, hate, or instructions for serious wrongdoing.
• Probe, disrupt, overload, damage, or gain unauthorized access to the Service or related systems.
• Circumvent quotas, subscriptions, security controls, safety filters, or access restrictions.
• Reverse engineer, scrape, copy, resell, sublicense, or commercially exploit the Service except where law expressly permits it.
• Use automated means to access the Service without our written authorization.
• Use the Service or its output to develop, train, benchmark, or improve a competing model or service without our written authorization.

We may investigate suspected misuse and remove content, restrict features, suspend access, or report conduct to authorities where reasonably necessary.

12. Sharing stories and links

If Lula AI gives you a story-sharing or media link, anyone who receives that link may be able to view or access its contents. You are responsible for choosing recipients and for ensuring the story, child information, photo, voice, and other content are appropriate to share. Do not post private links publicly unless you intend to make their contents accessible.

13. Third-party services

Lula AI relies on third-party services for artificial intelligence, voice generation, image generation, hosting, storage, notifications, subscriptions, and App Store distribution. Third-party services may have their own terms and privacy notices. We are not responsible for third-party products or acts outside our reasonable control, but this does not limit any responsibility that cannot legally be excluded.

14. Service changes and availability

We may add, change, limit, or discontinue features; change providers; impose reasonable usage limits; or perform maintenance. We will provide notice where required by law. We do not guarantee uninterrupted availability, permanent storage of generated content, compatibility with every device, or that any particular provider or feature will remain available.

Keep copies of content you need. We are not a permanent archival or backup service.

15. Suspension, termination, and deletion

You may stop using Lula AI at any time and may start account deletion through the app. Account deletion is described in the Privacy Policy and does not cancel an Apple subscription.

We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or harm, fail to pay applicable charges, or if suspension is reasonably necessary for security or legal compliance. Where appropriate and legally required, we will provide notice and an opportunity to remedy the issue.

Sections that by their nature should continue—including intellectual property, payment obligations already incurred, disclaimers, liability limits, and dispute terms—survive termination.

16. Disclaimers

To the maximum extent permitted by law, Lula AI and all output are provided "as is" and "as available." Horus disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded or limited.

17. Limitation of liability

To the maximum extent permitted by law, Horus and its directors, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, or opportunities; or harm arising from reliance on AI output, even if advised that such harm was possible.

To the maximum extent permitted by law, our total liability arising from the Service or these Terms will not exceed the greater of (a) the amount you paid to Horus through Lula AI during the 12 months before the event giving rise to the claim or (b) USD 50.

These limitations do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that applicable law does not permit us to exclude or limit. Mandatory consumer rights remain unaffected.

18. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold Horus harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the Service, your User Content, your violation of another person's rights, or your material violation of these Terms. This section does not apply to the extent a claim was caused by Horus or where such an obligation is prohibited by consumer law.

19. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. Courts and enforcement offices in Istanbul will have jurisdiction where legally permitted.

If you are a consumer, this choice does not deprive you of mandatory protections or courts available under the laws of your habitual residence. Before filing a claim, we encourage you to contact hello@horusstudios.com so we can try to resolve the issue informally.

20. Apple App Store terms

For Lula AI downloaded from Apple's App Store, you and Horus acknowledge that:

• These Terms are between you and Horus, not Apple, and Horus—not Apple—is responsible for Lula AI and its content.
• Apple has no obligation to provide maintenance or support for Lula AI.
• If Lula AI fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by its terms. To the maximum extent permitted by law, Apple has no other warranty obligation.
• Horus, not Apple, is responsible for addressing claims relating to Lula AI, including product-liability, legal-compliance, and consumer-protection claims, subject to these Terms and applicable law.
• Horus, not Apple, is responsible for investigating, defending, settling, and discharging a third-party intellectual-property claim relating to Lula AI.
• You represent that you are not located in a country subject to a United States government embargo or designated as a terrorist-supporting country and are not on a United States government prohibited- or restricted-party list.
• You must comply with applicable third-party terms when using Lula AI.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce this section against you.

21. Changes to these Terms

We may update these Terms to reflect changes to Lula AI, our providers, or applicable law. We will post the updated Terms with a new effective date and provide additional notice where required. If you do not agree to a material change, you must stop using the Service. Changes do not reduce rights already accrued under mandatory law.
